Nationwide Class Certification Denied in Case Against Wyndham Hotels

A New York State Supreme Court issued a 22-page decision on February 8 denying plaintiffs' motion to certify a nationwide class of hotel guests who had paid mandatory resort fees. Plaintiffs alleged that the imposition of resort fees by the hotel company violated consumer protection laws and was fraudulent. The court rejected class certification, ruling, among other things, that individual issues overwhelmed common questions. Kasowitz's Jed Bergman represented Wyndham.
