Kasowitz Client, NFL Star Shawne Merriman, Awarded Millions in Judgment Against Former NBA Stars

On December 13, 2010, the United States District Court for the District of Maryland entered a judgment of nearly $4 million and awarded various interests in real estate projects to Kasowitz client and NFL player Shawne Merriman in an action against former NBA and Duke players Christian Laettner and Brian Davis.  Mr. Merriman and his company lent Laettner and Davis $3 million in 2007.  Laettner and Davis defaulted on the loan in March 2009.  Kasowitz was retained in March 2010 following the denial of plaintiffs’ motion for summary judgment.  After taking discovery and eliciting admissions by defendants to having borrowed funds from Merriman and defaulted in their obligations to repay them, Kasowitz refiled for summary judgment.  The Court granted Merriman’s motion awarding Merriman the full amount claimed, the real estate interests, and the right to seek legal fees and costs of collection.  Kasowitz partners Marc E. Kasowitz and David E. Ross represented Merriman in this matter.
