New Mexico Appellate Court Affirms Grant of Summary Judgment to Kasowitz Client Liggett Group in Antitrust Action

On November 18, 2008, the New Mexico Court of Appeals affirmed the grant of summary judgment in favor of Kasowitz client, Liggett Group on alleged antitrust violations.  The case, which sought hundreds of millions in damages, concerned the claim by a statewide class of retail customers that five of the largest cigarette manufacturers, including Liggett, had unlawfully conspired to fix cigarette prices in New Mexico .  The trial court had granted summary judgment in favor of all defendant-manufacturers.  The appellate court affirmed the dismissal with respect to Liggett and one other manufacturer, but reversed that ruling as to the remaining three defendants.  Kasowitz partner Leonard Feiwus and Counsel Julie Fischer represented Liggett in this action.
