Kasowitz Secures Appellate Victory for Ryan LLC against USA Today
On behalf of Ryan LLC, an industry-leading tax recovery service based in Dallas, Texas, Kasowitz Benson Torres has defeated USA Today’s second attempt to dismiss Ryan’s defamation lawsuit arising out of USA Today’s false reporting that Ryan, while securing legitimate tax savings for its clients -- including $2 million in tax savings for USA Today itself -- engaged in improper business practices that triggered an FBI investigation—when in fact there were no such improper practices and no such investigation.
In a decision issued earlier today, the Beaumont Court of Appeals affirmed the trial court’s decision denying USA Today’s motion to dismiss Ryan’s defamation claims. In its decision, the Beaumont Court of Appeals agreed that there was no evidence that Ryan’s tax challenges were “baseless,” “frivolous” or even “questionable,” as USA Today had falsely reported, or that the USA Today reporter had even “interviewed anyone with Ryan before publishing the news articles at issue.” Ryan will continue to press the lawsuit to set the record straight, to recover its damages, and to hold USA Today accountable for its willful, malicious and unlawful conduct.
