Kasowitz Secures Decisive Appellate Victory Against Manhattan Luxury Building Condo Board

On April 23, 2024, Kasowitz Benson Torres, on behalf of condominium unit owners in a NYC luxury condominium building, secured an appellate victory against the condominium board in a New York Appellate Division, First Department decision.
 
Kasowitz brought an interlocutory appeal challenging the trial court’s order, which found that the condo owners had not timely completed a $10 million renovation of their condo and upheld the board’s assessment of substantial fines, attorneys’ fees and the filing of a lien.  Adopting the Kasowitz team’s arguments, the First Department vacated the trial court's order because, among other reasons, it was based on insufficient evidence and procedurally improper.  Following the appellate victory, the case settled favorably on behalf of the firm’s clients.
