Alycia Regan Benenati’s practice focuses on complex commercial litigation, including class actions, contractual disputes, securities litigation, antitrust and intellectual property disputes. Alycia has represented corporate and sovereign clients in state and federal courts throughout the country and in domestic and international arbitrations.
Prior to joining Kasowitz, Alycia served as law clerk to the Honorable Steven M. Gold, U.S. District Court for the Eastern District of New York.
Work Highlights
- MBIA in a decade-long put-back action against Credit Suisse in which MBIA sought to recover for breaches of representations and warranties related to RMBS insured by MBIA. After a two-week bench trial in New York State Supreme Court, the court found that MBIA had convincingly proved that Credit Suisse breached its representations and warranties, and that Credit Suisse was liable for over $600 million in damages.
- Comcast Corporation in three antitrust class actions brought by a putative class of two million subscribers in each case. These are test cases for the entire cable industry. The U.S. Supreme Court ruled in favor of Comcast in a landmark 5-4 decision that, based on Kasowitz's cross-examination of Plaintiffs' damages expert, overturned class certification.
- The heirs to the Herzog Collection, the largest private art collection in Hungary prior to World War II, in a lawsuit against the Hungarian government and its state-owned museums and university seeking the return of more than 40 artworks with an estimated combined value of more than $100 million.
- The developer of one of the largest real estate projects in the Tri-state area, in litigation with a lender.
- Canadian toy manufacturer MEGA Brands in connection with Lanham Act claims brought against it by a competitor.
- A major oil company in a national price fixing class action brought against it by gas station owners and operators.
- A major U.S. bank in class actions relating to the bank’s activities in South Africa during the former apartheid regime.
- A major U.S. bank and a major foreign bank in class actions arising from the banks’ activities in France during World War II.
