Brandy Worden

Brandy Worden, CIPP/US, CIPP/E, Chair of Kasowitz’s Data Strategy, Privacy and Security team, focuses her practice on developing creative and pragmatic solutions for privacy and AI counselling, litigation, and regulatory investigations.  

Brandy has a proven track record of developing and implementing comprehensive global privacy and AI strategies in alignment with regulatory requirements and business goals.  Brandy has deep knowledge of global privacy and AI laws, and has extensive experience both in-house at Meta, one of the largest technology companies in the world, and as outside counsel advising clients on privacy and AI, litigation, and regulatory investigations.

Brandy has advised on a wide range of laws, including U.S., State, and international laws covering privacy, international data transfers, biometrics, marketing, healthcare, youth privacy, educational privacy, AI, content moderation, financial privacy, unfair and deceptive business practices, as well as the regulation of use of personal data and technology.  She has also developed compliance programs for clients covering a wide array of technologies, including AI, the blockchain, cloud storage services, VR, social media, web crawling, biotechnology, biometrics, medical devices, encryption, AdTech, and chatbots.

Brandy has also counselled clients through regulatory inquiries, regulatory investigations and litigation related to privacy (including Schrems matters), marketing, cybersecurity, and regulatory issues (including cases involving State AGs, the FTC, and international data protection regulatory bodies).  She has extensive experience resolving privacy disputes informally and at early stages to avoid potential litigation or further regulatory action or penalties.

Brandy also has experience in cyber-incident preparedness and response, including developing cyber-incident response plans, conducting table-top exercises and acting as a breach coach.

Brandy has dual certifications in EU and U.S. privacy from the International Association of Privacy Professionals and a Harvard Cybersecurity Risk Management Certification.  She was recognized as a 2022 Super Lawyers Rising Star for Technology Transactions.  She has published multiple thought-leadership pieces on privacy and AI, and has been featured in Bloomberg and the Financial Times.

Prior to joining Kasowitz, Brandy served as the head of a global privacy team at Meta, and previously worked as a privacy partner and practice group leader at another national law firm.  She also clerked for the Federal Trade Commission and the United States Attorney’s Office, Civil Division.
