Thomas J. Amburgy’s practice focuses on complex civil litigation. T.J. has experience working with publicly traded companies, real estate developers, insurance companies, production companies, non-profits, manufacturers, litigation trusts and individuals in a variety of complex commercial, securities, contract, tort, employment, and bankruptcy-related matters in federal and state court. T.J. also represents clients in mediations and arbitrations, and volunteers to provide pro bono legal services to individuals seeking asylum in the New York Immigration Court.

Work Highlights
- Teva Pharmaceuticals, and its U.S. subsidiary Actavis, in defense of antitrust actions commenced by the State Attorneys General for 48 states, 28 civil antitrust class actions and multiple direct actions, consolidated in an MDL in the Eastern District of Pennsylvania that alleges price-fixing of over 100 generic drugs.
- Fairfax Financial Holdings, the largest insurance company in Canada, in recovering $31 million, including winning a jury verdict of $5.4 million in compensatory damages against hedge fund Exis Capital and a $5.5 million jury verdict in punitive damages against Exis Capital and two former executives in a New Jersey RICO case involving blatant insider trading, market manipulation and short selling attacks by hedge funds and investment firms. Defendant Morgan Keegan settled with Fairfax for $20 million shortly before trial. Fairfax secured additional settlements with other defendants.
- Adelphia Recovery Trust in a multi-billion dollar lawsuit against several hundred financial institutions, including the largest banks in the United States, for, among other things, intentional and constructive fraudulent conveyances, fraud, equitable subordination, equitable disallowance, and aiding and abetting fraud and breach of fiduciary duty.
- Google in obtaining dismissal with prejudice of $1.6 billion antitrust claims against Google under the Sherman Act for alleged monopolization and alleged violation of the California unfair competition state law.
- Fashion designer Rachel Roy against a former corporate business partner to prevent an unauthorized sale of the designer’s trademark and intellectual property rights.
- The Related Companies in disputes with a Chinese joint venture partner.
- Theatrical production company against the author of an Off-Broadway production to recover advanced royalties, expenditures, and licensing rights stemming from breaches of contract and tortious interference.
- Age Group in a multi-million dollar lawsuit against Martha Stewart Living Omnimedia for breaches of contract stemming from Martha Stewart Living’s interference with Age Group’s ability to fully exploit its bargained-for exclusive license to use the Martha Stewart brand on pet products. After successfully defeating motions to dismiss and for summary judgment, as well as subsequent appeals, the matter was resolved on the eve of trial.
- The successful Third Circuit appeal dismissing breach of fiduciary duty verdicts against certain officers and directors of the historic Lemington Home in Pittsburgh, Pennsylvania.
